Prenuptial and Postnuptial Agreements

Prenuptial ("prenup") and postnuptial ("postnup") agreements are legal contracts that mandate how a couple’s assets and debts will be divided in the event of a divorce or death.

 

The difference is timing: prenups are signed before the marriage, while postnups are signed after.

You should consider a Prenup/Postnup if you are bringing unequal assets to the marraige, if you own abusiness and want to ensure the operations of the business are not interupted with divorce proceedings, if you want to ensure what assets or debts would remain with either spouse, if you have children from a previous relationship and want to protect assets for those children, or if you expect a large inheritance that you want to ensure is kept within your family of origin in the event of divorce.

Within the agreement, you can specify how property is divided, wheter spousal support of any type is paid under what circumstances.

This type of agreement saves you from leaving the division of your property up to Pennsylvnia laws.
